QUALIFIED ELECTRONIC SIGNATURE CERTIFICATES MANAGEMENT REVOCATION OF A CERTIFICATE

Reasons for revocation of a certificate

The validity of the certificates issued by the Provider is automatically terminated when:

  • The validity of the electronic signature certificate expires;
  • The company of the Certification services provider is terminated, liquidated, and winded-up but its business activity was not transferred to another Certification services provider.

The Certification services provider must revoke a certificate, regardless of whether the subscriber listed in the certificate consents, if the certification authority confirms that:

  • The Holder or the Author of the certificate has deceased or is under judicial disability;
  • The company of the Holder is terminated, liquidated or winded-up;
  • The representative power of the Author with respect to the Holder is terminated;
  • A material fact represented in the certificate is false to prevent prospective harm to persons potentially relying on digital signatures verifiable by reference to the certificate.

Upon ascertaining the relevant circumstances, the Provider undertakes immediate actions to revoke the certificate and upon effecting such a revocation, the certification authority must promptly notify the Author and the Holder subscribed in the revoked certificate.

Who is authorized to request revocation of an issued certificate?

The Certification services provider must revoke a certificate at the request of the Holder or the Author, if the authority has confirmed that the person requesting revocation is the Holder, respectively the Author subscribed in the certificate or if the requester is acting as an agent with sufficient authority to effect revocation.

Procedure for requesting revocation

To revoke an issued electronic signature certificate, the Certifying authority of the Provider must:

  • Receive a written request for revocation from the Holder, respectively the Author;
  • The Registration authority of the Provider must verify the identity and the representative power of the Holder, respectively the Author.

(2) The holder or his/hers qualified representative files the request for revocation of the issued certificate:

  • The web page of the provider, if the Applicant is a registered user and has the respective access rights;
  • Personally in a Registration department of the Provider by signing Request for revocation of an issued electronic signature certificate.

The identification and authentication of the applicants who have filed requests for revocation are performed by the Registration authority of the Provider. The later addresses the request for revocation to the Provider upon the request filed by the Holder or the Author and after the control identity check is completed and confirmed.

The Holder, the Author or the duly authorized agent of the Holder, who could request revocation of an issued certificate, must present before the Registration authority in person the following official documents:

  • Valid identity document: personal identity card or personal passport;
  • Notarized Power of attorney by the accredited representative authorizing him/her to stand proxy for the Holder before the Provider for all the actions related to the issuing and management of the certificate;
  • Official document, substantiating the representative power of the Author court decision, certificate for actual commercial registration, notarized Power of attorney or other authorizing statement;
  • Signed Request for revocation of the certificate.

Promptly upon revoking the certificate, the Provider lists it in the Certificate suspension and revocation list, updates the publicly accessible electronic register and notifies the Holder and the Author directly or by the intercession of the Registration authority.

The revoked certificates are not subject to reactivation.

The validity of the electronic signature certificate is suspended for a fixed time period of 48 hours as from the day and hour the request is received.

After the free period of 48 hours elapses and in case the control verification performed by the Registration authority is successfully completed, the certificate is revoked.

In case the control verification performed by the registration is not confirmed or if during the grace period the Holder explicitly requests so, respectively the Author, the validity of the certificate is reactivated.

Period for processing the revocation request by the Certification authority.

The control verification of the facts and the confirmation that the evidences are sufficient and the revocation request is adequate are completed in a sensible time and the Provider revokes the certificate by the fixed time of 48 hours as from the moment the documents are accepted.

Control verification requirements towards the parties before revoking the certificate.

The trusting parties ought to trust the certificates issued by the Provider only after the status of the certificate is checked up in the Certificate suspension and revocation list or if they are presented with information automatically provided by the Provider through OCSP protocol.

If the trusting party fails to perform the control verification of the certificate status, the Provider bears no legal responsibility for any consequential damages whatsoever.

Frequency of publication of the Certificate suspension and revocation list.

After the certificate is listed in the Certificate suspension and revocation list and the list is updated new one is immediately and automatically published.

The validity period of the Certificate suspension and revocation list is 3 astronomic hours.

Maximum possible delay for publishing the updated list
The Certificate suspension and revocation list is automatically updated 5 minutes after the suspended or revoked certificate is listed in it or 5 minutes after a reactivated certificate is removed from the list.
